Terms and Condition - Haulage
Under the AMH Conditions of Carriage, any haulage contract in Malaysia is formally entered into when the customer submits a Request for Delivery (RFD) or Request for Transport (ROT) to the carrier — this serves as the binding agreement and supersedes any prior verbal or written terms. The carrier is not a common carrier, meaning it reserves the right to refuse service and provides carriage only under these standardized conditions. The contract defines essential elements including tariffs, charges, detention fees, limitation of liability, sub‑contracting rights, liabilities in case of force majeure, and procedures around loading/unloading, consignment notes, transit, and delivery obligations.
Charges and payment terms are set out clearly. Additional fees such as detention, futile trip, stallage, or storage may apply under specified circumstances, with free‐time provisions and detention charges defined by published tariff schedules. Liability for loss or damage is limited in scope, customers must indemnify the carrier for certain risks not covered, and insurance obligations are clearly laid out, including requirements for transit liability coverage and customer‐purchased insurance with waiver of subrogation.
